Do I Need a Tree Report or Arborist Report?

Victoria's Clause 52.37 applies different rules to canopy trees and boundary canopy trees. Whether you need a permit or supporting arborist report depends on the tree's size, position, planning controls, proposed work, and any applicable exemption.

Which report do you need?

The right tree report depends on what is happening on the property. Choose the closest situation below, or request a quote if you are not sure yet.

Clause 52.37: canopy tree or boundary canopy tree?

Clause 52.37 first defines a canopy tree by its size. A tree must meet all three criteria:

  • Height greater than 5 metres
  • Trunk circumference greater than 0.5 metres, measured at 1.4 metres above ground level
  • Canopy diameter of at least 4 metres

Its position on the site then determines which category applies:

Boundary canopy tree

A qualifying canopy tree with any part of its trunk within 6 metres of the site's narrowest street frontage, or within 4.5 metres of the rear boundary.

Canopy tree

A tree that meets the size criteria but is outside those front and rear boundary areas.

In the zones covered by Clause 52.37, a permit is generally required to remove, destroy, or lop a canopy tree. Where a site already has a dwelling, the clause provides an exception for a canopy tree outside the boundary areas. That existing-dwelling exception does not apply to a boundary canopy tree.

Important: In the diagram, "permit always required" means the existing-dwelling exception does not apply to a boundary canopy tree. Clause 52.37 contains other specific exemptions, and local laws, overlays, or native vegetation controls may also affect the property. Confirm the current controls before carrying out works.
